Wade in June 2022. The Dobbs v. Jackson decision returned the power to regulate abortion to the states, and Georgia responded by passing one of the strictest abortion laws in the country, banning the procedure after six weeks of pregnancy.
When Thurman sought medical help, her doctors faced legal uncertainty. They needed to perform a dilation and curettage (D&C) procedure to remove the remaining fetal tissue, but they were reportedly unsure whether such an intervention was permitted under Georgia’s abortion law. Georgia law allowed for the removal of “a dead unborn child” in cases of spontaneous abortion, such as miscarriage or stillbirth, but Thurman’s abortion was deliberate, not spontaneous, creating ambiguity in the eyes of the medical professionals.
Thurman’s death, according to a maternal mortality review committee, could have been prevented if the D&C had been performed sooner. Piedmont Henry Hospital, where she was treated, did not have a clear policy to guide doctors on how to interpret the state’s abortion ban in such cases.
Vice President Harris seized on the ProPublica report to criticize her political opponents, particularly former President Donald Trump, who is often credited with appointing the Supreme Court justices responsible for overturning Roe v. Stuckey and other critics argue that Thurman’s death was primarily related to the medication abortion she underwent, which left fetal tissue in her body, resulting in a deadly infection. They stress that Georgia’s abortion laws do not prohibit D&C procedures when the fetus has already passed, as was the case in Thurman’s situation. Instead, the failure to perform the necessary D&C promptly is being attributed to hospital negligence or confusion over the interpretation of the law.
Stuckey stated, “She tragically tried to abort her twins via a medication abortion. As is too often the case, parts of the baby were left inside her, which caused her to suffer from fatal sepsis. Yes, she should have received a D&C and antibiotics. But that is not the fault of any Georgia law, which fully permits a D&C when the baby has already passed. She died because of the abortion pills and because of the negligence of doctors.”
Critics like Stuckey accuse Harris of leaving out crucial details in her post, particularly the fact that Thurman chose to have an abortion and that the complications arose from the procedure itself, not from any law forcing her to carry a pregnancy to term.
