According to ABC News, Andrew and Tristan Tate will remain in a Miami jail after a US judge denied their bid for release while they contest extradition to Britain. Miami-based US Magistrate Judge Lauren Louis ruled that their wealth and frequent international travel made them flight risks.
Judge Louis wrote that, regardless of whether the brothers possess the extravagant holdings they portray online, the record showed they had an exceptional capacity to flee the jurisdiction. Their lawyers had argued that their public visibility would make flight impractical and described online displays of wealth as theatrical and grandiose.
Andrew Tate, 39, and Tristan Tate, 38, were arrested in Miami on July 18 after Britain sought their extradition over charges including rape, assault and facilitating trafficking for sexual exploitation. The dual US and British citizens have denied wrongdoing. Their lawyers said they would continue to defend themselves and engage with appropriate legal processes in each jurisdiction.
Prosecutors said there was a strong presumption in favour of detention in international extradition cases and argued the brothers could pose a danger to the public. Judge Louis said the nature of the allegations indicated they posed dangers to the community. The brothers testified at an August 27 Miami federal court hearing that crude online remarks were part of playing characters.
The extradition process could take months. US court records show Britain has until September 16 to submit its full request to the State Department. Britain is seeking to extradite the brothers over allegations involving four alleged victims between July 2010 and August 2017, as well as earlier rape and human trafficking charges involving three alleged victims. They have not appeared in a British court to enter a plea.
