According to ABC News, Lindsay Clancy’s lawyer has asked a judge to investigate the conduct of the sole juror who wanted to convict the Massachusetts woman over the deaths of her three young children. A mistrial was declared earlier this month after the jury could not reach a unanimous verdict.

In a motion filed on Friday and made public on Monday, local time, lawyer Kevin Reddington asked the court to question juror Michael Desronvil about alleged mobile phone use during deliberations and his truthfulness in a prospective-juror questionnaire and later questioning by the judge. Phone use during deliberations is prohibited in Massachusetts.

Mr Reddington also asked the court to obtain records of any calls or texts Mr Desronvil made between 8am and 4:30pm on each day the jury deliberated. He wants the motion heard at the next scheduled hearing on September 29. Mr Desronvil has not been accused of wrongdoing connected with his jury service.

Eleven of the 12 jurors were prepared to clear Ms Clancy of criminal responsibility, with the majority believing she was experiencing postpartum psychosis when she killed her children. Mr Desronvil supported prosecutors, who argued she knew what she was doing. He said he had no doubts and believed the evidence showed Ms Clancy knew exactly what she was doing.

In a separate Monday motion, defence lawyer Martin Weinberg asked the judge to dismiss the case rather than order a new trial. He argued the judge could have replaced the holdout juror with an alternate after the foreperson complained that one juror was refusing to listen to the law on reasonable doubt. Prosecutors have not said whether they will retry Ms Clancy, who remains charged with murder and is in a psychiatric hospital until the case is resolved.
