Marcelo Gomes da Silva, an 18-year-old from Brazil, was arrested by ICE while on his way to volleyball practice in Milton, Massachusetts. The incident occurred after he picked up teammates on a drizzly Saturday morning last year. Initially believing he was being pranked, Marcelo was shocked when police lights flashed behind him, leading to his detention.
According to ABC News, Marcelo had been living in the U.S. since he was six years old. Although he had a student visa, it had lapsed, placing him in the crosshairs of an immigration crackdown initiated by the Trump administration. During the arrest, ICE agents instructed everyone in the vehicle not to use their phones, leading to a distressing scene as Marcelo was handcuffed in front of his friends.
The current immigration landscape has seen almost 70,000 individuals detained by ICE, with a significant portion lacking any criminal convictions. Previously, many detainees could secure bond hearings, but recent changes in policy have made these hearings more difficult to obtain. Lawyers are now employing habeas corpus writs to challenge the legality of detentions, a strategy that has gained traction in the ongoing crackdown.
Marcelo’s lawyer filed a writ of habeas corpus the day after his arrest, arguing that he had no criminal history and was eligible for asylum. The urgency of legal action is heightened by the fact that ICE frequently relocates detainees, complicating the ability of lawyers to respond swiftly. Caitlyn Burgess, an immigration lawyer, noted that the administration often ignores court orders regarding detainee releases, highlighting a significant erosion of due process rights.
After spending six days in detention, Marcelo was eventually released, but the impact of his experience lingers. His case exemplifies the challenges faced by many in the immigration system, where legal avenues are often obstructed. Community support for Marcelo was evident, as classmates rallied for his release, making his story a focal point in the ongoing debate over immigration policies in the U.S.
