The class action trial led by Numurkah resident Kevin Green against GrainCorp has concluded, with a verdict not expected until November. The case centers on allegations of noise and odour pollution from GrainCorp’s factory, which Green claims has adversely affected his family’s health and finances.
According to ABC News, the Supreme Court of Victoria heard testimonies from multiple class action members and expert witnesses regarding the impact of the factory’s operations. Green, the lead applicant among 18 participants, stated that the expansion of the canola processing facility has led to significant disturbances, including noise that disrupted his family’s sleep and a strong odour he described as ‘frightening’.
During the trial, Green’s lawyer argued that since 2017, GrainCorp had a history of expanding operations without adequately addressing the resulting emissions. In contrast, GrainCorp’s legal counsel contended that the company proactively manages noise and odour issues. The court also heard about a recent explosion at the facility that raised safety concerns for nearby residents.
The defense suggested that Green’s focus on the factory’s impact might be excessive, lacking substantial medical evidence to support his claims. However, the plaintiff’s legal team maintained that their expert evidence confirmed the factory had exceeded noise limits. The trial included discussions about how to organize the substantial evidence presented to assist Justice Stephen O’Meara in making a decision.
