According to ABC News, the Australian Securities and Investments Commission has fined Downward Spiral Enterprises, the company owned by Mona founder David Walsh, nearly $200,000 for failing to lodge a financial report on time.

Downward Spiral Enterprises is the parent company of Morilla Estate, which operates Hobart’s Museum of Old and New Art. Walsh is the company’s sole director. ASIC said the business was among 22 large companies issued infringement notices for allegedly failing to lodge their 2025 financial reports. Each notice was for $198,000.

ASIC said the notices resulted from ongoing surveillance and enforcement focused on financial-reporting compliance. The regulator said the 22 companies had paid a combined $4.3 million in fines, while stressing that payment of an infringement notice does not amount to an admission of guilt or liability. Its investigation remains ongoing where a company has paid a notice but still has outstanding reporting obligations.

In June, Downward Spiral lodged eight years of accounts with ASIC. The accounts covering 2019 to 2025 showed more than $695 million in dividend income supporting Mona and other Walsh businesses, including Moorilla Estate, Moo Brew and DarkLab, which operates Dark Mofo. The company made a $63.9 million profit in 2024–25, largely driven by a $114 million dividend from an undisclosed source, offsetting continuing losses from Mona.

ASIC said it had conducted data-focused surveillance of large proprietary companies since August 2025, receiving more than $13.7 million in infringement-notice payments. It said 147 companies had subsequently lodged one or more outstanding reports. Commissioner Kate O’Rourke said timely reporting helps shareholders, creditors and others assess a company’s financial position and performance, and said ASIC would continue surveillance into 2027.
