According to ABC News, a family member of an Aboriginal boy seriously injured after two 12-year-olds were allegedly struck by a ute in Mildura has expressed “deep concern and disappointment” after the accused driver was granted bail.

The boys were riding a single motorised bicycle through Langtree Mall last Thursday night when they were allegedly pursued and hit by a ute travelling at almost 80 kilometres per hour. One boy was airlifted to the Royal Children’s Hospital in Melbourne after suffering a collapsed lung and fractures, while the other was treated for concussion and minor arm injuries.

Andrew Brien, 56, faced Mildura Magistrates’ Court on Wednesday on four counts of reckless conduct endangering life, along with charges including dangerous driving causing serious injury and intentionally causing injury. He was granted bail on conditions including that he not drive and observe a 9pm curfew, and is due back in court in December.

The family member said false claims and racist, violent social-media comments had added to the families’ distress. Victoria Police urged people not to share misinformation while proceedings continue. Senior Constable Mitchell Carew told the court the boys were “categorically” not involved in any offences.

The family is asking government and local representatives to consider whether bail laws adequately protect alleged victims of serious crime, particularly children and Aboriginal families. ABC News reported police had increased patrols in the area following the incident.
