According to ABC News, the Commonwealth Director of Public Prosecutions has declined to take carriage of the case against federal Labor MP Luke Gosling, who faces assault charges involving Northern Territory Administrator David Connolly.

Police allege Mr Gosling assaulted Mr Connolly at the NT Thai Grand Festival in Darwin on July 18. A court has previously heard the allegations included a claim that Mr Gosling struck Mr Connolly with his elbow. Mr Gosling has categorically denied the allegations and said he will contest the charges.

The NT Director of Public Prosecutions referred the matter to the Commonwealth earlier this month because of a perceived conflict of interest. The CDPP said it had initially indicated it was likely to be able to take the matter, but sought advice on how that could occur.

After considering powers under the Director of Public Prosecutions Act 1983 (Cth), the CDPP determined it could not conduct a state or territory prosecution in this case. The NT DPP said it remained of the view that it should not conduct the matter and was considering alternative arrangements.

Mr Gosling’s lawyer, Marty Aust SC, said he had serious concerns about the investigation and the handling of information and material. Mr Gosling was also charged this week with breaching bail conditions and has stepped down as special envoy for defence, veterans’ affairs and Northern Australia. His next court mention is scheduled for September 30.
