According to SBS News, Erin Patterson will face the Victorian Court of Appeal this week as she seeks to overturn convictions for murdering three relatives and attempting to murder a fourth after a July 2023 family lunch in Gippsland.
Patterson, 51, was sentenced to life in prison last year with a non-parole period of 33 years. She was found guilty of murdering her estranged husband’s parents, Don and Gail Patterson, both 70, and Gail Patterson’s sister, Heather Wilkinson, 66. The three died after eating beef Wellington laced with lethal death cap mushrooms at Patterson’s Leongatha home. Heather Wilkinson’s husband, Ian Wilkinson, became gravely ill but survived.
The two-day hearing is due to begin on Wednesday at the Court of Appeal in Melbourne’s CBD. It is an application for leave to appeal, meaning the court must first decide whether the case has merit for an appeal. A panel of three judges will consider written and oral arguments from the prosecution and defence. Patterson is not expected to attend in person and is instead expected to appear by video link from prison.
In documents lodged last year, Patterson argued that she suffered a “miscarriage of justice” during her 10-week trial on seven grounds. Her claims include that the prosecution’s five-day cross-examination was “unfair and oppressive,” that its closing address caused a substantial miscarriage of justice, and that there was a fundamental irregularity when the jury was sequestered. The Victorian Supreme Court had confirmed the jury was unknowingly staying at the same hotel as the lead detective and two prosecution members.
If the court grants the appeal and Patterson succeeds, it could quash the convictions and order a retrial, or acquit her. If it rules against her, the convictions will remain in place, though she could appeal to the High Court. The Director of Public Prosecutions is also challenging the sentence, seeking life without parole or a non-parole period longer than 33 years.
